Car Accidents Attorney in Worcester, Massachusetts

A car accident may occur in a split second, but it can affect your life for years to come. “But worry not, I have my auto insurance that will cover all my accident-related expenses!” you might be thinking. Unfortunately, this couldn’t be further from the truth.

If you’re like most people who have never been in a serious automobile accident before, you probably expect your insurance company to pay your claim instantly and treat you fairly. Insurers are profit-driven businesses that strive to keep their costs down with quick, lowball settlements and claim denials.

At Gregory Casale Attorney At Law, I know how a car crash can turn your life upside down and how many obstacles you may encounter when trying to obtain the compensation to which you are entitled. When you work with me, you can count on my unparalleled guidance and compassionate support.

With over 25 years of experience as a car accident attorney in Worcester, Massachusetts, I always have the best interests of my clients at heart and work tirelessly to secure the compensation to which they are entitled.

Types of Auto Accident Cases I Handle

While no two automobile wrecks are the same, almost all crashes fall into some broad categories. If you are looking for a Worcester car accident attorney, you might want to hire one who has handled a variety of auto accident cases and, what’s more important, has experience with cases similar to yours.

At Gregory Casale Attorney At Law, I have represented clients who have been in the following types of collisions:

  • Head-on crashes

  • Rear-end collisions

  • Side-swipe collisions

  • Backing crashes

  • Intersection accidents

  • Highway accidents

  • Parking lot accidents

  • Single-vehicle accidents

  • Multi-vehicle accidents

  • Chain-reaction crashes

  • Rollover accidents

Regardless of the type or nature of the crash that left you injured or resulted in the death of your loved one, I can help you fight for your rights and the compensation to which you are entitled.

What Causes Most Car Accidents?

When driving, motorists owe each other a duty to follow traffic laws and drive carefully. If this duty was never breached, there would be no automobile accidents. A motorist may cause a car crash when they:

  • Drive while distracted

  • Exceed the posted speed limit

  • Drive faster than is reasonable under the circumstances

  • Drive in an aggressive manner (road rage)

  • Drive in a reckless manner

  • Run red lights or stop signs

  • Fail to yield the right of way

  • Fail to maintain a safe following distance (tailgating)

  • Drive while fatigued

  • Drive while impaired by alcohol or drugs

  • Make illegal or unsafe turns

  • Make illegal or unsafe lane changes

  • Engage in unsafe passing maneuvers

  • Drive with defective automobile parts (e.g., faulty brakes)

Having represented people involved in car accidents since 1998, I know how important it is to determine what caused the crash early on. When I take on any case, the first thing I do is launch a comprehensive investigation to understand how the collision occurred and who is liable.

Common Car Accident Injuries

Unfortunately, most accidents on the road cause an injury or death. While not all injuries are serious, any injury can bring chaos into your life, even if it’s minor. Some of the most common types of injuries suffered by victims of automobile wrecks include:

  • Whiplash

  • Concussion

  • Traumatic brain injury

  • Broken bones

  • Fractured bones

  • Spinal cord injury

  • Burns

  • Chest injuries

  • Knee injuries

  • Hand and wrist injuries

  • Leg and ankle injuries

  • Internal organ damage

  • Loss of limb

  • Paralysis

This is a non-exhaustive list of injuries. Regardless of the nature and severity of your injury, you are entitled to financial compensation if the other party was entirely or mostly at fault for the crash. At Gregory Casale Attorney At Law, I can analyze the facts of your case and help you pursue the compensation you need to get your life back on track.

How to Get Compensation After a Car Crash in Massachusetts

When it comes to seeking compensation for your damages and losses, you are legally required to prove the other party’s fault. The only exception is when you live in a no-fault state like Massachusetts, where drivers can seek compensation no matter whose fault contributed to the crash.

As long as you have Personal Injury Protection (PIP) insurance, which is mandatory in Massachusetts, you can obtain compensation for some of your damages and losses even if you were at fault. However, PIP coverage will only cover your medical expenses and up to 75% of your lost income and replacement services with a total limit of $8,000, according to the official website of the Commonwealth of Massachusetts.

But what if your damages and losses are more than $8,000? In that case, you will have to file a lawsuit against the other party. And this time, fault does matter, as you will have to prove the driver is responsible for your accident to obtain personal injury compensation. If your fault contributed to the crash, you might still be entitled to compensation as long as you are less than 51% at fault under Massachusetts’s modified comparative negligence doctrine (Massachusetts General Law Chapter 231 § 85). However, your compensation will be reduced by the percentage of your fault.
