How to Get Compensation After a Car Crash in Massachusetts
When it comes to seeking compensation for your damages and losses, you are legally required to prove the other party’s fault. The only exception is when you live in a no-fault state like Massachusetts, where drivers can seek compensation no matter whose fault contributed to the crash.
As long as you have Personal Injury Protection (PIP) insurance, which is mandatory in Massachusetts, you can obtain compensation for some of your damages and losses even if you were at fault. However, PIP coverage will only cover your medical expenses and up to 75% of your lost income and replacement services with a total limit of $8,000, according to the official website of the Commonwealth of Massachusetts.
But what if your damages and losses are more than $8,000? In that case, you will have to file a lawsuit against the other party. And this time, fault does matter, as you will have to prove the driver is responsible for your accident to obtain personal injury compensation.
